Asylum Lawyer

Rigorous, well-documented representation for people seeking protection in the United States from persecution.

Asylum protects people who cannot safely return to their home country because they fear persecution based on their race, religion, nationality, political opinion, or membership in a particular social group. Winning an asylum case depends on credible testimony and strong, well-organized evidence.

Attorney Nagima Muzapberova prepares asylum cases thoroughly and represents clients in their own language, with particular experience serving Russian-speaking and Central Asian applicants.

Who qualifies for asylum

To qualify, you generally must show a well-founded fear of persecution on account of one of the five protected grounds, carried out by the government or by a group the government cannot or will not control.

There is normally a one-year filing deadline from your last arrival in the United States, though important exceptions exist. Because that deadline is strict, it is worth speaking with an attorney early rather than waiting.

Affirmative and defensive asylum

If you are not in immigration court, you apply affirmatively by filing Form I-589 with USCIS and attending an asylum interview. If you are already in removal proceedings, you apply defensively before an immigration judge. The two paths involve different strategy, evidence, and preparation.

In either path, careful country-conditions evidence and a consistent, well-prepared account are decisive. Applicants also generally become eligible to apply for a work permit once their case has been pending for the required period.

Frequently asked questions

What is the one-year deadline for asylum?

You generally must apply for asylum within one year of your most recent arrival in the United States. There are exceptions — for example, changed or extraordinary circumstances — but they are limited, so it is best to consult an attorney as early as possible.

What is the difference between affirmative and defensive asylum?

Affirmative asylum is filed with USCIS when you are not in removal proceedings and includes an interview. Defensive asylum is presented to an immigration judge when you are in removal proceedings. The preparation and strategy differ, which is why legal guidance matters.

Can I work while my asylum case is pending?

In most cases you can apply for a work permit once your asylum application has been pending for the required waiting period. The timing is set by regulation, and we help you file as soon as you are eligible.

How much does an asylum lawyer cost?

Asylum representation is a flat fee quoted after your consultation. A one-hour consultation is $175, and payment plans are available for qualifying clients. Many asylum applications have no government filing fee.
